According to the prosecution, on January 27, 2011, Thana Cantt Bharat Raj Singh was patrolling the area with the police team. He received information that the area was being terrorized by Rajesh and Rakesh Kumar Paswan, sons of Dhaniram, resident of Fatehpur Saraiya, Vansh Raj Yadav and Barsaati Kori. It was learnt that the gang leader Rajesh Kumar Paswan along with his associates makes raw liquor and runs a business. A case of poisonous liquor business is also registered against them. Accused Vanshraj died while being imprisoned in jail. Another accused Barsaati died during the trial of the case. The defence argued that in the poisonous liquor business on the basis of which the Gangster Act proceedings were conducted against Rajesh and Rakesh, all the accused have been acquitted due to lack of evidence. After hearing the arguments of the prosecution and the defence, the judge acquitted both the real brothers Rajesh and Rakesh due to lack of evidence.
